Terms of Service

These Terms of Service (the Terms) govern the Erase website at erasephoto.com, its web tools and cloud processing APIs, purchases made on the website through Stripe, and related support pages (together, Erase). The website is operated by MachineWill, LLC (the Operator), which is also the seller for web purchases. The Erase iOS and Android apps are covered by the separate app Terms. 1. Agreement and eligibility

By installing or using Erase, you agree to these Terms and the Privacy Policy. If you do not agree, do not use Erase. You must be legally able to enter this agreement. A parent or legal guardian must authorize use by anyone who cannot form a binding agreement in their jurisdiction.

2. What Erase provides

Erase provides photo editing tools such as object, text, person, watermark, and background removal; upscaling; restrained on-device photo finishing; de-AI processing; watermark creation; exports; and, where expressly made available, video processing. Some tools run on the device. Cloud tools send media and editing instructions to processors described in the Privacy Policy. Features, providers, processing time, and availability may change when necessary to maintain quality, safety, cost, or service reliability.

3. Your media and results

You retain your rights in photos, videos, logos, text, masks, and other content you submit (User Media). You grant the Operator a limited, non-exclusive, worldwide licence to host, copy, transmit, transform, and process User Media only as needed to provide, secure, troubleshoot, and support the requested Erase feature. This licence ends when the relevant data is deleted, subject to short-lived technical copies and records we must retain for security, fraud prevention, or legal compliance.

As between you and the Operator, you may use generated or edited results to the extent permitted by applicable law and any rights in the source media. Erase does not grant rights in third-party people, brands, copyrighted works, trademarks, or other material contained in an input or result.

4. Use only media you have the right to edit

You may process only media that you own or are authorized to edit. You must not use Erase to remove copyright notices, ownership marks, watermarks, signatures, safety information, or provenance information when you lack permission; infringe intellectual-property, privacy, publicity, or contractual rights; create or distribute unlawful, deceptive, harassing, exploitative, or non-consensual intimate material; impersonate another person; evade access controls; attack or overload the service; reverse engineer protected service components; or use automated means to abuse credits, ads, purchases, or provider capacity.

5. AI and editing limitations

Cloud and on-device processing can be incomplete or wrong. Results may contain artifacts, omit details, alter text, faces, identity cues, geometry, colours, or layout, or fail entirely. Review every result before publishing, relying on it, or deleting the original. Erase is a creative editing tool, not evidence authentication, legal advice, medical advice, or a guarantee that media is genuine, accurate, non-infringing, or suitable for a particular purpose.

6. Accounts, Works, and availability

Erase may create an anonymous Supabase account on first use. You are responsible for device security. Cloud jobs can be queued, canceled, fail, time out, or become temporarily unavailable because of networks or third-party providers. Keep your own copy of important originals and exports. The Works library is a convenience, not a permanent backup service.

7. Credits and rewarded ads

Erase may provide an initial credit and may offer an additional credit after a completed rewarded ad. Current balances and available actions are shown in the app. Image tools use the same shared balance: for Free users, each image operation uses one credit; Pro image operations use no credits. On-device Beautify and Add Watermark still process locally, but the first Save or Share of each source-and-settings result uses that shared balance; preview adjustments do not use credits, and repeated Save or Share attempts for the unchanged result are not charged twice. Credits are a limited service entitlement: they have no cash value, are not transferable, and may be corrected when issued through error, fraud, duplicate events, or abuse. If an ad cannot load, Erase may allow the requested action without an ad; this is not a promise that every failed ad will grant a credit.

8. App purchases

Purchases made in the Erase iOS or Android app are handled by the App Store or Google Play and are governed by the separate app Terms; purchases on this website are covered by the Stripe section below.

9. Account deletion

When signed in on the website, you can open Settings and choose Delete Account. After confirmation, Erase removes the account identity, account-linked Works and result files, and the job, credit, order, and subscription records it holds for the account. Deletion also cancels future renewal of a website subscription but does not refund an existing charge. Provider webhook payloads are scrubbed while non-identifying event IDs and processing status may remain to prevent replay and document system integrity. Deletion cannot be undone.

10. Operator intellectual property

Erase software, branding, interfaces, documentation, and service infrastructure, excluding User Media, are owned by or licensed to the Operator. These Terms give you a personal, limited, revocable, non-exclusive, non-transferable right to use Erase as provided through the App Store. They do not permit resale, sublicensing, copying of protected source code, or use of Erase branding without permission.

11. Suspension and termination

The Operator may restrict or suspend access when reasonably necessary to investigate abuse, protect users or providers, comply with law, address security or payment risk, or enforce these Terms. Where practical, we will limit the action to what is necessary. You may stop using Erase at any time and may delete your account in Settings.

12. Disclaimers and liability

To the maximum extent permitted by law, Erase is provided on an “as available” basis without warranties that processing will be uninterrupted, error-free, or suitable for every image or purpose. Nothing in these Terms excludes warranties, remedies, or liability that cannot lawfully be excluded, including mandatory consumer rights. To the maximum extent permitted by law, the Operator is not liable for indirect or consequential loss, lost profits, lost data, loss caused by your lack of rights in User Media, or decisions made without reviewing an output. The Operator's aggregate liability relating to Erase will not exceed the greater of the amount you paid for Erase in the 12 months before the event giving rise to the claim or the minimum amount required by applicable law.

13. Changes, governing arrangement, and contact

We may update these Terms for product, provider, legal, or safety changes. Material changes will be posted here with a new effective date and, when appropriate, communicated in the app. Your continued use after the effective date means you accept the updated Terms.

Except where mandatory law in your place of residence provides otherwise, these Terms and any non-contractual disputes arising from them are governed by the laws of the State of Delaware, United States, where the Operator is organized, and the state and federal courts located in Delaware have jurisdiction over disputes. This clause does not take away non-waivable consumer protections or any forum rights required by local law.

Web purchases through Stripe

MachineWill, LLC is the seller for purchases made on the Erase website. Web purchases are processed by Stripe in US dollars. Stripe Checkout shows the plan, price, payment method, and any applicable tax before confirmation. The $2.99 weekly and $19.99 yearly subscriptions are charged today and renew automatically until canceled in the Stripe billing portal; cancellation takes effect at the end of the current paid period. The $59.99 lifetime plan is a one-time charge and does not renew. A full refund removes the related Pro access. Deleting the Erase account cancels future Stripe subscription renewal and removes account-linked access, but does not refund an existing charge. Mandatory consumer and refund rights still apply.
